OSH legislation is the result of the vested interests of doctors and lawyers rather than genuine concern for employee health or management excellence. Do you agree with this statement? Discussion. Executive Summary Workplace health and safety legislation is a crucial aspect for all workplaces to ensure employee safety. The legislation was created to protect employees, firstly to ensure ways to prevent accidents at work and secondly, that in the event of an accident the employee is guaranteed compensation. Occupational health and safety benefits both the workplace and workers and is the result of concerns about employee health and workplace risks, as well as management excellence and workplace harm reduction of work. It was not an outcome for the interests of doctors and lawyers. Occupational health and safety (OH&S) legislation is a set of rules that promote the safety of workers in the workplace. These rules are based on the Occupational Health and Safety Act 2004 (Work Safe Australia, 2014, p.1) which aims to improve workplace safety in Victoria, however these are regulated and enforceable nationally. This law ensures that certain precautions are taken in work activities by both employers and employees to the benefit of both parties through minimizing health or harmful risks and ensuring that management of the workplace occurs with minimal complications . Every profession and workplace encourages and educates employees on OSH procedures and how to optimize personal safety. This creates a win-win situation, as employees are guaranteed safety while the workplace reduces the liability they have to injured employees, as well as the risk of employee injuries.
